
{"id":845,"date":"2022-06-16T14:24:01","date_gmt":"2022-06-16T14:24:01","guid":{"rendered":"https:\/\/podpora.nuggetsw.cz\/?p=845"},"modified":"2022-06-16T14:24:02","modified_gmt":"2022-06-16T14:24:02","slug":"placene-volno-u-vedoucich-na-tabore","status":"publish","type":"post","link":"https:\/\/podpora.nuggetsw.cz\/index.php\/2022\/06\/16\/placene-volno-u-vedoucich-na-tabore\/","title":{"rendered":"Placen\u00e9 volno u vedouc\u00edch na t\u00e1bo\u0159e"},"content":{"rendered":"\n<p>V p\u0159edchoz\u00edch letech m\u011bli n\u00e1rok zam\u011bstnanci na \u010derp\u00e1n\u00ed <strong>3 t\u00fddn\u016f neplacen\u00e9ho volna v kalend\u00e1\u0159n\u00ed<\/strong>m roce podle \u00a7 203, odst. 2 p\u00edsm. h) Z\u00e1kon\u00edku pr\u00e1ce:<\/p>\n\n\n\n<p><em>&#8222;<var> h)<\/var> k \u010dinnosti vedouc\u00edch t\u00e1bor\u016f pro d\u011bti a ml\u00e1de\u017e, jejich z\u00e1stupc\u016f pro v\u011bci hospod\u00e1\u0159sk\u00e9 a zdravotn\u00ed, odd\u00edlov\u00fdch vedouc\u00edch, vychovatel\u016f, instruktor\u016f, pop\u0159\u00edpad\u011b st\u0159edn\u00edch zdravotnick\u00fdch pracovn\u00edk\u016f v t\u00e1borech pro d\u011bti a ml\u00e1de\u017e; p\u0159\u00edslu\u0161\u00ed pracovn\u00ed volno v nezbytn\u011b nutn\u00e9m rozsahu, nejv\u00fd\u0161e v\u0161ak 3 t\u00fddny v kalend\u00e1\u0159n\u00edm roce, pokud tomu nebr\u00e1n\u00ed v\u00e1\u017en\u00e9 provozn\u00ed d\u016fvody na stran\u011b zam\u011bstnavatele, a za podm\u00ednky, \u017ee zam\u011bstnanec nejm\u00e9n\u011b po dobu 1 roku p\u0159ed uvoln\u011bn\u00edm pracoval soustavn\u011b a bezplatn\u011b s d\u011btmi nebo s ml\u00e1de\u017e\u00ed. Podm\u00ednka soustavn\u00e9 a bezplatn\u00e9 pr\u00e1ce se nevy\u017eaduje, jde-li o t\u00e1bory pro zdravotn\u011b posti\u017een\u00e9 d\u011bti a ml\u00e1de\u017e, &#8222;<\/em><\/p>\n\n\n\n<p><strong>Podm\u00ednkou poskytnut\u00ed volna<\/strong> byla skute\u010dnost, \u017ee tomu nebr\u00e1nily v\u00e1\u017en\u00e9 provozn\u00ed d\u016fvody na stran\u011b zam\u011bstnavatele a \u017ee zam\u011bstnanec nejm\u00e9n\u011b po dobu <strong>1 roku p\u0159ed uvoln\u011bn\u00edm pracoval soustavn\u011b a bezplatn\u011b s d\u011btmi nebo s ml\u00e1de\u017e\u00ed<\/strong> (v souvislosti s t\u00e1borem, na kter\u00fd \u017e\u00e1dal o poskytnut\u00ed pracovn\u00edho volna). Tato \u00faprava plat\u00ed i nad\u00e1le.\u00a0<\/p>\n\n\n\n<p><strong>Zam\u011bstnanec za\u017e\u00e1d\u00e1 p\u00edsemn\u011b o neplacen\u00e9 volno v d\u00e9lce a\u017e 3 t\u00fddn\u016f, z toho o 1 t\u00fdden s n\u00e1hradou mzdy<\/strong>.<\/p>\n\n\n\n<p>Dohodnutou \u010d\u00e1st z tohoto pracovn\u00edho volna (1 t\u00fdden) proplat\u00ed <strong>zam\u011bstnavatel <\/strong>\u017eadateli <strong>v b\u011b\u017en\u00e9m v\u00fdplatn\u00edm term\u00ednu<\/strong>. <\/p>\n\n\n\n<p><em>Z\u00e1kon\u00edk pr\u00e1ce v \u00a7 350a stanov\u00ed, \u017ee <strong>t\u00fddnem se pro \u00fa\u010dely tohoto z\u00e1kona rozum\u00ed 7 po sob\u011b n\u00e1sleduj\u00edc\u00edch kalend\u00e1\u0159n\u00edch dn\u016f<\/strong>. Nejde tedy o\u00a0kalend\u00e1\u0159n\u00ed t\u00fdden, a\u00a0proto t\u00fdden ve smyslu z\u00e1kon\u00edku pr\u00e1ce m\u016f\u017ee za\u010d\u00ednat kter\u00fdmkoli kalend\u00e1\u0159n\u00edm dnem a\u00a0skon\u010d\u00ed uplynut\u00edm n\u00e1sleduj\u00edc\u00edch 6 po sob\u011b jdouc\u00edch kalend\u00e1\u0159n\u00edch dn\u016f. N\u00e1hrada mzdy bude poskytnuta za sm\u011bny, kter\u00e9 do tohoto obdob\u00ed p\u0159ipadaj\u00ed (u krat\u0161\u00edch pracovn\u00edch \u00favazk\u016f to bude nap\u0159. jen 1 sm\u011bna, u\u00a0pln\u00e9ho pracovn\u00edho \u00favazku zpravidla 5 sm\u011bn).<\/em><\/p>\n\n\n\n<p><strong>Pro rok 2022<\/strong> bude br\u00e1na jako <strong>max. hranice pr\u016fm\u011brn\u00e1 mzda v n\u00e1rodn\u00edm hospod\u00e1\u0159stv\u00ed za prvn\u00ed a\u017e t\u0159et\u00ed \u010dtvrtlet\u00ed roku 2021 ve v\u00fd\u0161i 37 047,- K\u010d<\/strong> (viz. sd\u011blen\u00ed Ministerstva pr\u00e1ce a soci\u00e1ln\u00edch v\u011bc\u00ed \u010d. 494\/2021 Sb.) Zam\u011bstnavatel se m\u016f\u017ee rozhodnout i pro poskytnut\u00ed n\u00e1hrady mzdy p\u0159esahuj\u00edc\u00ed tento z\u00e1konn\u00fd n\u00e1rok \u2013 tato nen\u00e1rokov\u00e1 \u010d\u00e1st n\u00e1hrady mzdy v\u0161ak zam\u011bstnavateli nebude refundov\u00e1na ze strany OSSZ.\u00a0N\u011bkter\u00e9 OSSZ mohou po\u017eadovat potvrzen\u00ed o tom, \u017ee se zam\u011bstnanec skute\u010dn\u011b t\u00e1bora z\u00fa\u010dastnil.<\/p>\n\n\n\n<p>Zam\u011bstnavatel po vyplacen\u00ed n\u00e1hrady mzdy (platu) zam\u011bstnanci pod\u00e1 na p\u0159\u00edslu\u0161nou OSSZ \u017e\u00e1dost o&nbsp;refundaci z\u00e1konem n\u00e1rokovateln\u00e9 n\u00e1hrady. Zam\u011bstnavatel m\u016f\u017ee OSSZ \u017e\u00e1dat o refundaci nejpozd\u011bji do 3 let od vyplacen\u00ed n\u00e1hrady mzdy zam\u011bstnanci. P\u0159ilo\u017e\u00ed p\u0159i tom doklad o vyplacen\u00ed n\u00e1hrady mzdy zam\u011bstnanci a o spln\u011bn\u00ed z\u00e1konn\u00fdch po\u017eadavk\u016f ze strany zam\u011bstnance (toto potvrzuje p\u016fvodn\u00ed \u017e\u00e1dost zam\u011bstnance o neplacen\u00e9 volno).<\/p>\n\n\n\n<p>Zam\u011bstnavatel m\u016f\u017ee OSSZ podat \u017e\u00e1dost o refundaci nejpozd\u011bji do 3let od vyplacen\u00ed n\u00e1hrady mzdy zam\u011bstnanci.<\/p>\n\n\n\n<p>Zam\u011bstnavatel pou\u017eije jednu ze mzdov\u00fdch slo\u017eek pro n\u00e1hrady mzdy 575-578 \u2013 100%. Pozor na v\u00fd\u0161i proplacen\u00e9 n\u00e1hrady k refundaci.
