P\u0159ipome\u0148me si v tomto \u010dl\u00e1nku podm\u00ednky pro poskytnut\u00ed tohoto volna.<\/p>\n\n\n\n<p>Od za\u010d\u00e1tku roku 2021 maj\u00ed zam\u011bstnanci, kte\u0159\u00ed p\u016fsob\u00ed jako vedouc\u00ed na t\u00e1borech pro d\u011bti a ml\u00e1de\u017e, n\u00e1rok na t\u00fdden placen\u00e9ho pracovn\u00edho volna za kalend\u00e1\u0159n\u00ed rok. V minulosti byla definice term\u00ednu &#8222;d\u011bti a ml\u00e1de\u017e&#8220; nejasn\u00e1. Od roku 2024 ji\u017e pr\u00e1vn\u00ed \u00faprava \u00a7203a (7) vymezuje tuto skupinu jako osoby mlad\u0161\u00ed 26 let.<\/p>\n\n\n\n<p>\u017d\u00e1dost o volno pod\u00e1v\u00e1 zam\u011bstnanec sv\u00e9mu zam\u011bstnavateli, kter\u00fd n\u00e1sledn\u011b obdr\u017e\u00ed n\u00e1hradu mzdy od p\u0159\u00edslu\u0161n\u00e9 Okresn\u00ed spr\u00e1vy soci\u00e1ln\u00edho zabezpe\u010den\u00ed (OSSZ), pokud si za\u017e\u00e1d\u00e1 o refundaci. <\/p>\n\n\n\n<p>Zam\u011bstnanci v pracovn\u00edm pom\u011bru, kte\u0159\u00ed jsou vedouc\u00edmi na t\u00e1borech pro d\u011bti a ml\u00e1de\u017e, mohou vyu\u017e\u00edt a\u017e t\u0159i t\u00fddny neplacen\u00e9ho volna v pr\u016fb\u011bhu kalend\u00e1\u0159n\u00edho roku podle \u00a7 203a Z\u00e1kon\u00edku pr\u00e1ce. Jednou z podm\u00ednek pro poskytnut\u00ed tohoto volna je, \u017ee zam\u011bstnanec pracoval s d\u011btmi nebo ml\u00e1de\u017e\u00ed soustavn\u011b a bezplatn\u011b po dobu nejm\u00e9n\u011b jednoho roku p\u0159ed ud\u011blen\u00edm, a \u017ee ud\u011blen\u00ed volna nebr\u00e1n\u00ed z\u00e1va\u017en\u00e9 provozn\u00ed d\u016fvody na stran\u011b zam\u011bstnavatele. Tato ustanoven\u00ed plat\u00ed v z\u00e1kon\u00edku pr\u00e1ce ji\u017e del\u0161\u00ed dobu a st\u00e1le z\u016fst\u00e1vaj\u00ed platn\u00e1.<\/p>\n\n\n\n<p>Tato pr\u00e1vn\u00ed \u00faprava se v\u0161ak nevztahuje na zam\u011bstnance vykon\u00e1vaj\u00edc\u00ed pr\u00e1ci na z\u00e1klad\u011b dohod o prac\u00edch konan\u00fdch mimo pracovn\u00ed pom\u011br. Podle \u00a7 77 odst. 2 p\u00edsm. e) a odst. 3 z\u00e1kon\u00edku pr\u00e1ce nelze tato omezen\u00ed aplikovat na tuto skupinu zam\u011bstnanc\u016f.<\/p>\n\n\n\n<p class=\"has-text-align-left\" style=\"font-size:15px\"><em>&#8230; <var>(3)<\/var>&nbsp;Zam\u011bstnanci pracuj\u00edc\u00edmu na z\u00e1klad\u011b dohody o proveden\u00ed pr\u00e1ce nebo dohody o pracovn\u00ed \u010dinnosti nep\u0159\u00edslu\u0161\u00ed n\u00e1hrada odm\u011bny z dohody po dobu trv\u00e1n\u00ed jin\u00fdch d\u016fle\u017eit\u00fdch osobn\u00edch p\u0159ek\u00e1\u017eek v pr\u00e1ci podle \u00a7 199 a p\u0159ek\u00e1\u017eek v pr\u00e1ci z d\u016fvodu obecn\u00e9ho z\u00e1jmu podle \u00a7 200 a\u017e 205, nen\u00ed-li dohodnuto nebo vnit\u0159n\u00edm p\u0159edpisem stanoveno jinak.<\/em><\/p>\n\n\n\n<p>Podle \u00a7 104 odst. 2 p\u00edsm. b) z\u00e1kona \u010d. 234\/\u200b2014 Sb., o st\u00e1tn\u00ed slu\u017eb\u011b, ve zn\u011bn\u00ed pozd\u011bj\u0161\u00edch p\u0159edpis\u016f, m\u00e1 st\u00e1tn\u00ed zam\u011bstnanec n\u00e1rok na plat za dobu p\u0159ek\u00e1\u017eky ve slu\u017eb\u011b v souladu s \u00a7 203 odst. 2 a \u00a7 203a z\u00e1kon\u00edku pr\u00e1ce, pokud je tato p\u0159ek\u00e1\u017eka placen\u00e1 podle t\u011bchto pracovn\u011bpr\u00e1vn\u00edch ustanoven\u00ed.<\/p>\n\n\n\n<p>Z\u00e1kon\u00edk pr\u00e1ce, platn\u00fd od 1. ledna 2021, \u0159\u00edk\u00e1:<\/p>\n\n\n\n<p>Za jeden t\u00fdden (co\u017e obvykle p\u0159edstavuje 5 a\u017e maxim\u00e1ln\u011b 7 pracovn\u00edch dn\u00ed) z t\u0159\u00edt\u00fddenn\u00edho pracovn\u00edho volna v kalend\u00e1\u0159n\u00edm roce m\u016f\u017ee zam\u011bstnanec z\u00edskat n\u00e1hradu mzdy ze st\u00e1tn\u00edch prost\u0159edk\u016f (n\u00e1hradu mzdy\/\u200bplatu vypl\u00e1c\u00ed zam\u011bstnavatel, a o refundaci pak n\u00e1sledn\u011b \u017e\u00e1d\u00e1 u OSSZ) &#8211; viz. \u00a7 203a z\u00e1kon\u00edku pr\u00e1ce. Je mo\u017en\u00e9 uplatnit a\u017e t\u0159i t\u00fddny volna (z toho jeden t\u00fdden s n\u00e1hradou mzdy) v kalend\u00e1\u0159n\u00edm roce i pro vedouc\u00ed sportovn\u00edch soust\u0159ed\u011bn\u00ed pro d\u011bti a ml\u00e1de\u017e &#8211; viz. \u00a7 203a z\u00e1kon\u00edku pr\u00e1ce. <\/p>\n\n\n\n<p><strong>Kdo m\u00e1 n\u00e1rok na placen\u00e9 volno?<\/strong><\/p>\n\n\n\n<p>N\u00e1rok je vymezen v \u00a7203a z\u00e1kon\u00edku pr\u00e1ce takto:<\/p>\n\n\n\n<p><em>&#8230;Pracovn\u00ed volno souvisej\u00edc\u00ed s akc\u00ed pro d\u011bti a ml\u00e1de\u017e<br>(1) Pracovn\u00ed volno pro jin\u00fd \u00fakon v obecn\u00e9m z\u00e1jmu p\u0159\u00edslu\u0161\u00ed zam\u011bstnanci<br>a) k \u010dinnosti vedouc\u00edch t\u00e1bor\u016f pro d\u011bti a ml\u00e1de\u017e a jejich z\u00e1stupc\u016f pro v\u011bci hospod\u00e1\u0159sk\u00e9 a zdravotn\u00ed,<br>b) k \u010dinnosti odd\u00edlov\u00fdch vedouc\u00edch, vychovatel\u016f, instruktor\u016f a st\u0159edn\u00edch zdravotnick\u00fdch pracovn\u00edk\u016f v t\u00e1borech pro d\u011bti a ml\u00e1de\u017e a<br>c) k obdobn\u00fdm \u010dinnostem na sportovn\u00edch soust\u0159ed\u011bn\u00edch d\u011bt\u00ed a ml\u00e1de\u017ee,<br>a to v nezbytn\u011b nutn\u00e9m rozsahu, nejv\u00fd\u0161e v\u0161ak 3 t\u00fddny v kalend\u00e1\u0159n\u00edm roce.<\/em><\/p>\n\n\n\n<p><em>(2) Pracovn\u00ed volno zam\u011bstnanci p\u0159\u00edslu\u0161\u00ed,<br>a) nebr\u00e1n\u00ed-li tomu v\u00e1\u017en\u00e9 provozn\u00ed d\u016fvody na stran\u011b zam\u011bstnavatele a<br>b) zam\u011bstnanec nejm\u00e9n\u011b po dobu 1 roku bezprost\u0159edn\u011b p\u0159ed uvoln\u011bn\u00edm pracoval soustavn\u011b a bezplatn\u011b s d\u011btmi nebo s ml\u00e1de\u017e\u00ed; tato podm\u00ednka se nevy\u017eaduje, jde-li o t\u00e1bory nebo sportovn\u00ed soust\u0159ed\u011bn\u00ed pro zdravotn\u011b posti\u017een\u00e9 d\u011bti a ml\u00e1de\u017e.<\/em><\/p>\n\n\n\n<p><em>(3) Za dobu \u010derp\u00e1n\u00ed pracovn\u00edho volna p\u0159\u00edslu\u0161\u00ed zam\u011bstnanci za podm\u00ednek a v rozsahu uveden\u00fdch v odstavc\u00edch 4 a 5 n\u00e1hrada mzdy nebo platu, pokud se jedn\u00e1 o akci po\u0159\u00e1danou pr\u00e1vnickou osobou,<br>a) zapsanou ve ve\u0159ejn\u00e9m rejst\u0159\u00edku pr\u00e1vnick\u00fdch a fyzick\u00fdch osob po dobu nejm\u00e9n\u011b 5 let a<br>b) pr\u00e1ce s d\u011btmi a ml\u00e1de\u017e\u00ed tvo\u0159\u00ed podstatnou \u010d\u00e1st jej\u00ed hlavn\u00ed \u010dinnosti.<br>Tuto skute\u010dnost je zam\u011bstnanec povinen zam\u011bstnavateli prok\u00e1zat.<\/em><\/p>\n\n\n\n<p>O refundac\u00edch na soci\u00e1ln\u00ed spr\u00e1v\u011b informuje sama \u010cesk\u00e1 spr\u00e1va soci\u00e1ln\u00edho zabezpe\u010den\u00ed <a rel=\"noreferrer noopener\" href=\"https:\/\/www.cssz.cz\/refundace-nahrady-mzdy\" target=\"_blank\">zde<\/a>.<\/p>\n\n\n\n<p>Jak zadat v Nuggetu placen\u00e9 volno najdete <a href=\"https:\/\/podpora.nuggetsw.cz\/index.php\/knowledge-base\/zamestnanec-placene-volno-u-vedoucich-na-tabore\/\" data-type=\"URL\" data-id=\"https:\/\/podpora.nuggetsw.cz\/index.php\/knowledge-base\/zamestnanec-placene-volno-u-vedoucich-na-tabore\/\" target=\"_blank\" rel=\"noreferrer noopener\">zde<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Bl\u00ed\u017e\u00ed se l\u00e9to a t\u00edm se znovu otev\u00edr\u00e1 ot\u00e1zka o volnu pro vedouc\u00ed na t\u00e1borech pro d\u011bti a ml\u00e1de\u017e.
