Vys\u00edlan\u00e1 osoba mus\u00ed b\u00fdt v zam\u011bstnaneck\u00e9m pom\u011bru.<\/p>\n<p style=\"padding-left: 40px;\">b) Vys\u00edl\u00e1 pracovn\u00edka sice do sv\u00e9ho podniku, ale tento podnik s\u00eddl\u00ed v jin\u00e9m st\u00e1t\u011b EU. Vys\u00edlan\u00e1 osoba mus\u00ed b\u00fdt v zam\u011bstnaneck\u00e9m pom\u011bru.<\/p>\n<p style=\"padding-left: 40px;\">c) P\u0159edpisy se tak\u00e9 vztahuj\u00ed na p\u0159\u00edpady, kdy prost\u0159ednictv\u00edm agentury, kter\u00e1 zprost\u0159edkov\u00e1v\u00e1 do\u010dasnou pr\u00e1ci, najme zahrani\u010dn\u00edho pracovn\u00edho z jin\u00e9ho st\u00e1tu EU, ne\u017e je podnik registrov\u00e1n \u010di v n\u011bm p\u016fsob\u00ed. V takov\u00e9m p\u0159\u00edpad\u011b mus\u00ed b\u00fdt uzav\u0159en mezi pracovn\u00edkem a agenturou pracovn\u00ed pom\u011br.<\/p>\n<p>P\u0159ed vysl\u00e1n\u00edm do hostitelsk\u00e9 zem\u011b se doporu\u010duje zjistit, zdali je v\u00fdkon pr\u00e1ce podm\u00edn\u011bn z\u00edsk\u00e1n\u00edm p\u0159\u00edslu\u0161en\u00e9ho pracovn\u00edho povolen\u00ed \u010di povolen\u00ed k pobytu (v\u00edza). Je vhodn\u00e9 zjistit, jak dlouho trv\u00e1 z\u00edsk\u00e1n\u00ed doklad\u016f a jak\u00e9 jsou podm\u00ednky pro jejich vyd\u00e1n\u00ed.<\/p>\n<p>I kdy\u017e \u010cesk\u00e1 republika vstoupila do Evropsk\u00e9 unie a je umo\u017en\u011bn voln\u00fd pohyb pracovn\u00edk\u016f, je v \u010dlensk\u00fdch zem\u00edch pot\u0159eba, aby zam\u011bstnavatel provedl registraci jin\u00e9ho ob\u010dana Evropsk\u00e9 unie na p\u0159\u00edslu\u0161n\u00e9m \u00fa\u0159ad\u011b pr\u00e1ce. \u010casto tak\u00e9 podl\u00e9h\u00e1 ob\u010das Evropsk\u00e9 unie povinnosti registrace a vy\u0159\u00edzen\u00ed p\u0159echodn\u00e9ho pobytu na m\u00edstn\u011b p\u0159\u00edslu\u0161n\u00fdch \u00fa\u0159adech.<\/p>\n<p>V n\u011bkter\u00fdch zem\u00ed je t\u0159eba pro z\u00edsk\u00e1n\u00ed povolen\u00ed k zam\u011bstn\u00e1n\u00ed zajistit potvrzen\u00ed o dobr\u00e9m zdravotn\u00edm stavu pracovn\u00edka. Jak\u00fdm zp\u016fsobem pak zam\u011bstnanec p\u0159edkl\u00e1d\u00e1 v\u00fdsledky sv\u00fdch zdravotn\u00edch test\u016f je t\u0159eba p\u0159edem zjistit v hostitelsk\u00e9 zemi.<\/p>\n<h3 style=\"text-align: center;\">Podm\u00ednky zam\u011bstn\u00e1n\u00ed v hostitelsk\u00e9 zemi<\/h3>\n<p>B\u011bhem vysl\u00e1n\u00ed mus\u00edte sv\u00e9mu zam\u011bstnanci zajistit stejn\u00e9 pracovn\u00ed podm\u00ednky, kter\u00e9 jsou platn\u00e9 ze z\u00e1kona \u010di na z\u00e1klad\u011b uzav\u0159en\u00e9 kolektivn\u00ed smlouvy tak\u00e9 v hostitelsk\u00e9 zemi.<\/p>\n<p>Jedn\u00e1 se o podm\u00ednky upravuj\u00edc\u00ed:<\/p>\n<ul>\n<li>minim\u00e1ln\u00ed dobu odpo\u010dinku<\/li>\n<li>maxim\u00e1ln\u00ed d\u00e9lku pracovn\u00ed doby<\/li>\n<li>minim\u00e1ln\u00ed d\u00e9lku placen\u00e9 dovolen\u00e9 za kalend\u00e1\u0159n\u00ed rok<\/li>\n<li>odm\u011bnu (v\u010detn\u011b v\u0161ech \u010d\u00e1st\u00ed), jak je definov\u00e1na ve vnitrost\u00e1tn\u00edch pr\u00e1vn\u00edch p\u0159edpisech nebo v kolektivn\u00ed smlouv\u011b<\/li>\n<li>bezpe\u010dnost a ochranu zdrav\u00ed p\u0159i pr\u00e1ci<\/li>\n<li>ochrann\u00e1 opat\u0159en\u00ed pro t\u011bhotn\u00e9 \u017eeny, \u010derstv\u00e9 maminky a lidem mlad\u0161\u00edm 18 let<\/li>\n<li>rovn\u00e9 zach\u00e1zen\u00ed \u017een a mu\u017e\u016f<\/li>\n<li>pokud zam\u011bstnavatel poskytuje ubytov\u00e1n\u00ed v hostitelsk\u00e9 zemi, tak podm\u00ednky ubytov\u00e1n\u00ed<\/li>\n<li>p\u0159\u00edsp\u011bvky nebo n\u00e1hrady na pokryt\u00ed cestovn\u00fdch v\u00fddaj\u016f, n\u00e1klad\u016f na stravu a ubytov\u00e1n\u00ed, jsou-li b\u011bhem vysl\u00e1n\u00ed vy\u017eadov\u00e1ny<\/li>\n<\/ul>\n<p>V p\u0159\u00edpad\u011b, \u017ee jsou pracovn\u00ed podm\u00ednky ve va\u0161em st\u00e1t\u011b v\u00fdhodn\u011bj\u0161\u00ed pro pracovn\u00edka ne\u017e v hostitelsk\u00e9 zemi, m\u011bli byste tyto v\u00fdhodn\u011bj\u0161\u00ed podm\u00ednky zachovat i b\u011bhem vysl\u00e1n\u00ed do zahrani\u010d\u00ed.<\/p>\n<p>V p\u0159\u00edpad\u011b, \u017ee je doba vysl\u00e1n\u00ed del\u0161\u00ed ne\u017e 12 m\u011bs\u00edc\u016f (18 m\u011bs\u00edc\u016f v p\u0159\u00edpad\u011b p\u0159edlo\u017een\u00ed od\u016fvodn\u011bn\u00ed), mus\u00edte sv\u00fdm zam\u011bstnanc\u016fm zaru\u010dit v\u0161echny povinn\u00e9 pracovn\u00ed podm\u00ednky v hostitelsk\u00e9 zemi. Krom\u011b podm\u00ednek t\u00fdkaj\u00edc\u00edch se pracovn\u00ed smlouvy \u010di dopl\u0148kov\u00fdch d\u016fchod\u016f.<\/p>\n<p><strong>Dal\u0161\u00ed pr\u00e1va p\u0159i vysl\u00e1n\u00ed do jin\u00e9 zem\u011b EU:<\/strong><\/p>\n<ul>\n<li>nebudete pot\u0159ebovat pracovn\u00ed povolen\u00ed<\/li>\n<li>nebudete si muset nech\u00e1vat uznat svou odbornou kvalifikaci (u n\u011bkter\u00fdch profes\u00ed, kter\u00e9 spadaj\u00ed do regulovan\u00fdch povol\u00e1n\u00ed, je v\u0161ak nutno p\u0159edlo\u017eit p\u00edsemn\u00e9 prohl\u00e1\u0161en\u00ed)<\/li>\n<li>jeli vysl\u00e1n\u00ed del\u0161\u00ed ne\u017e 3 m\u011bs\u00edc\u016f, mus\u00ed se pobyt ohl\u00e1sit u p\u0159\u00edslu\u0161n\u00fdch \u00fa\u0159ad\u016f<br \/>\nv hostitelsk\u00e9 zemi nez\u00edsk\u00e1 pracovn\u00edk pr\u00e1vo na trval\u00fd pobyt<\/li>\n<\/ul>\n<h3 style=\"text-align: center;\">Soci\u00e1ln\u00ed poji\u0161t\u011bn\u00ed<\/h3>\n<p>Zam\u011bstnanci b\u011bhem sv\u00e9 do\u010dasn\u00e9 pr\u00e1ce v n\u011bkter\u00e9 ze zem\u00ed EU mohou z\u016fstat poji\u0161t\u011bn\u00ed v syst\u00e9mu soci\u00e1ln\u00edho zabezpe\u010den\u00ed st\u00e1tu, v n\u011bm\u017e pracovali p\u0159ed vysl\u00e1n\u00edm.<br \/>\nZam\u011bstnavatel mus\u00ed p\u0159edem informovat p\u0159\u00edslu\u0161n\u00e9 org\u00e1ny hostitelsk\u00e9 zem\u011b a vy\u017e\u00e1dat si formul\u00e1\u0159 A1 neboli Potvrzen\u00ed o p\u0159\u00edslu\u0161nosti k pr\u00e1vn\u00edm p\u0159edpis\u016fm soci\u00e1ln\u00edho zabezpe\u010den\u00ed, kter\u00fd vyd\u00e1v\u00e1 spr\u00e1va soci\u00e1ln\u00edho zabezpe\u010den\u00ed zem\u011b, kde jsou zam\u011bstnanci poji\u0161t\u011bn\u00ed. Formul\u00e1\u0159 A1 stvrzuje, \u017ee vyslan\u00fd zam\u011bstnanec je registrov\u00e1n v syst\u00e9mu soci\u00e1ln\u00edho zabezpe\u010den\u00ed domovsk\u00e9 zem\u011b a nemus\u00ed proto hradit p\u0159\u00edsp\u011bvky na soci\u00e1ln\u00ed poji\u0161t\u011bn\u00ed ve vyslan\u00e9 zemi.<\/p>\n<p>P\u0159i pod\u00e1n\u00ed \u017e\u00e1dosti o vyd\u00e1n\u00ed formul\u00e1\u0159e A1 mus\u00ed zam\u011bstnavatel uv\u00e9zt datum zah\u00e1jen\u00ed a ukon\u010den\u00ed vysl\u00e1n\u00ed pracovn\u00edka v jin\u00e9 zemi EU. A maxim\u00e1ln\u00ed doba, kterou m\u016f\u017ee uv\u00e9st na formul\u00e1\u0159i, je 24 m\u011bs\u00edc\u016f. V p\u0159\u00edpad\u011b trv\u00e1n\u00ed vysl\u00e1n\u00ed del\u0161\u00ed ne\u017e 24 m\u011bs\u00edc\u016f \u010di pot\u0159eby formul\u00e1\u0159 prodlou\u017eit, zam\u011bstnavatel m\u016f\u017ee:<\/p>\n<ul>\n<li>po\u017e\u00e1dat \u00fa\u0159ad, kter\u00fd formul\u00e1\u0159 A1 vystavuje o prodlou\u017een\u00ed (pozor, povolen\u00ed se neud\u011bluje automaticky a je podm\u00edn\u011bno vz\u00e1jemnou dohodou mezi domovskou a hostitelskou zem\u00ed)<\/li>\n<li>nechat sv\u00e9ho zam\u011bstnance p\u0159ihl\u00e1sit do syst\u00e9mu soci\u00e1ln\u00edho zabezpe\u010den\u00ed hostitelsk\u00e9 zem\u011b<\/li>\n<\/ul>\n<h3 style=\"text-align: center;\">Zdravotn\u00ed poji\u0161t\u011bn\u00ed<\/h3>\n<p>Vyslan\u00fd zam\u011bstnanec, za kter\u00e9ho je hrazeno zdravotn\u00ed poji\u0161t\u011bn\u00ed v domovsk\u00e9m st\u00e1t\u011b, mus\u00ed m\u00edt po celou dobu vysl\u00e1n\u00ed u sebe Evropskou kartu zdravotn\u00edho poji\u0161t\u011bn\u00ed. Je to doklad, \u017ee jste zdravotn\u011b poji\u0161t\u011bn v n\u011bkter\u00e9 ze zem\u00ed EU.<\/p>\n<p>V n\u011bkter\u00fdch zem\u00edch je Evropsk\u00fd pr\u016fkaz zdravotn\u00edho poji\u0161t\u011bn\u00ed stejn\u00fd s pr\u016fkazem ve\u0159ejn\u00e9ho zdravotn\u00edho poji\u0161t\u011bn\u00ed dan\u00e9ho st\u00e1tu. Ale v n\u011bkter\u00fdch zem\u00ed je nutno o Evropsk\u00fd pr\u016fkaz za\u017e\u00e1dat.<\/p>\n<p>Je vhodn\u00e9 si tak\u00e9 u sv\u00e9 zdravotn\u00ed poji\u0161\u0165ovny zjistit ve\u0161ker\u00e9 informace o m\u00ed\u0159e zdravotn\u00edho poji\u0161t\u011bn\u00ed vztahuj\u00edc\u00ed se na pojistn\u00e9 kryt\u00ed rodinn\u00fdch p\u0159\u00edslu\u0161n\u00edk\u016f.<\/p>\n<p>Pou\u017eit\u00ed Evropsk\u00e9ho zdravotn\u00edho poji\u0161t\u011bn\u00ed m\u00e1 omezen\u00ed:<\/p>\n<ul>\n<li>nelze ho pou\u017e\u00edt pro \u00fa\u010dely z\u00e1chrann\u00fdch akc\u00ed \u010di repatriace<\/li>\n<li>nevztahuje se na l\u00e9\u010dbu v soukrom\u00fdch zdravotn\u00edch za\u0159\u00edzen\u00ed<\/li>\n<li>nevztahuje se na n\u00e1klady na pl\u00e1novanou zdravotn\u00ed p\u00e9\u010di v zem\u00edch EU<\/li>\n<\/ul>\n<p>V p\u0159\u00edpad\u011b, \u017ee nep\u0159etr\u017eit\u00fd pobyt zam\u011bstnance v zahrani\u010d\u00ed bude del\u0161\u00ed ne\u017e 6 m\u011bs\u00edc\u016f a bude v zahrani\u010d\u00ed tak\u00e9 zdravotn\u011b poji\u0161t\u011bn, m\u00e1 mo\u017enost se odhl\u00e1sit ze syst\u00e9mu zdravotn\u00edho poji\u0161t\u011bn\u00ed p\u0159ed odjezdem sv\u00e9 domovsk\u00e9 zem\u011b a pak za tohoto zam\u011bstnance nemus\u00ed zam\u011bstnavatel odv\u00e1d\u011bt pojistn\u00e9 na zdravotn\u00ed poji\u0161t\u011bn\u00ed. Ka\u017ed\u00e1 zem\u011b m\u00e1 sv\u00e1 pravila, proto je nutn\u00e9 se p\u0159edem o v\u0161ech aspektech informovat.
