Na rodi\u010dovsk\u00e9 dovolen\u00e9 jsou matky v\u00a0mimo eviden\u010dn\u00edm stavu a\u00a0<strong>rodi\u010dovsk\u00e1 dovolen\u00e1 je tud\u00ed\u017e vylou\u010denou dobou.<\/strong><\/p>\n\n\n\n<p><strong>Nemus\u00ed se rovnat d\u00e9lka pob\u00edr\u00e1n\u00ed rodi\u010dovsk\u00e9ho p\u0159\u00edsp\u011bvku s\u00a0d\u00e9lkou rodi\u010dovsk\u00e9 dovolen\u00e9<\/strong>, pokud si matka zvol\u00ed vypl\u00e1cen\u00ed rodi\u010dovsk\u00e9ho p\u0159\u00edsp\u011bvku na krat\u0161\u00ed dobu ne\u017e je \u010derp\u00e1n\u00ed rodi\u010dovsk\u00e9 dovolen\u00e9 do 3 let v\u011bku d\u00edt\u011bte. <\/p>\n\n\n\n<p>Po \u010derp\u00e1n\u00ed rodi\u010dovsk\u00e9 dovolen\u00e9 je nutn\u00e9, aby matka za\u017e\u00e1dala o <strong>neplacen\u00e9 volno a do 4 let v\u011bku d\u00edt\u011bte lze \u010derpat neplacen\u00e9 volno,\u00a0kter\u00e9 je tak\u00e9 vylou\u010denou dobou<\/strong>.<\/p>\n\n\n\n<ol class=\"wp-block-list\"><\/ol>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\"><strong>Vylou\u010den\u00e9 DNY<\/strong><\/h2>\n\n\n\n<p>Podl\u00e9haj\u00ed z\u00e1konu \u010d. 187\/2006 Sb. o nemocensk\u00e9m poji\u0161t\u011bn\u00ed, \u00a7 18 odst. 7 a vykazuj\u00ed se v&nbsp;tiskopisu \u201eOzn\u00e1men\u00ed zam\u011bstnavatele o \u017e\u00e1dosti o d\u00e1vku\u201c (do konce roku 2024 se jednalo o tiskopis &#8222;P\u0159\u00edloha k \u017e\u00e1dosti o d\u00e1vku&#8220;) pro \u010cSSZ. Tiskopis slou\u017e\u00ed jako podklad pro v\u00fdpo\u010det d\u00e1vek z&nbsp;nemocensk\u00e9ho poji\u0161t\u011bn\u00ed, je\u017e vypl\u00e1c\u00ed \u010cSSZ (nemoc nebo karant\u00e9na od 15. kalend\u00e1\u0159n\u00edho dne trv\u00e1n\u00ed, O\u0161et\u0159ovn\u00e9, Dlouhodob\u00e9 o\u0161et\u0159ovn\u00e9, Pen\u011b\u017eit\u00e1 pomoc v&nbsp;mate\u0159stv\u00ed \u2013 d\u00e1le jen PPM, Otcovsk\u00e1, Vyrovn\u00e1vac\u00ed p\u0159\u00edsp\u011bvek v&nbsp;t\u011bhotenstv\u00ed a mate\u0159stv\u00ed \u2013 zam\u011bstnankyn\u011b byla z&nbsp;d\u016fvodu t\u011bhotenstv\u00ed nebo mate\u0159stv\u00ed p\u0159evedena na jinou pr\u00e1ci a t\u00edm do\u0161lo k&nbsp;poklesu zapo\u010ditateln\u00e9ho p\u0159\u00edjmu). Vylou\u010den\u00e9 dny se uv\u00e1d\u00ed v&nbsp;kalend\u00e1\u0159n\u00edch dnech.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Vylou\u010den\u00e9 dny dle z\u00e1kona:<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>kalend\u00e1\u0159n\u00ed dny omluven\u00e9 nep\u0159\u00edtomnosti zam\u011bstnance v\u00a0pr\u00e1ci, za kter\u00e9 mu nen\u00e1le\u017e\u00ed n\u00e1hrada mzdy nebo platu s\u00a0v\u00fdjimkou kalend\u00e1\u0159n\u00edch dn\u016f DPN, za kter\u00e9 zam\u011bstnanci nevznikl n\u00e1rok na nemocensk\u00e9 z\u00a0d\u016fvodu v \u00a7 25 p\u00edsm. a) a c) (nemoc byla zp\u016fsobena \u00famysln\u011b nebo p\u0159i \u00fat\u011bku z\u00a0vazby \u010di v\u00fdkonu trestu);<\/li>\n\n\n\n<li>kalend\u00e1\u0159n\u00ed dny DPN nebo karant\u00e9ny, v\u00a0nich\u017e zam\u011bstnanci n\u00e1le\u017e\u00ed n\u00e1hrada mzdy nebo platu v\u00a0obdob\u00ed prvn\u00edch 14 kalend\u00e1\u0159n\u00edch dn\u00ed;<\/li>\n\n\n\n<li>kalend\u00e1\u0159n\u00ed dny, za kter\u00e9 bylo zam\u011bstnanci vypl\u00e1ceno nemocensk\u00e9, PPM, otcovsk\u00e1, o\u0161et\u0159ovn\u00e9 nebo dlouhodob\u00e9 o\u0161et\u0159ovn\u00e9;<\/li>\n\n\n\n<li>kalend\u00e1\u0159n\u00ed dny p\u0159ipadaj\u00edc\u00ed na m\u011bs\u00edce, za kter\u00e9 OSV\u010c neplat\u00ed pojistn\u00e9 na poji\u0161t\u011bn\u00ed;<\/li>\n\n\n\n<li>kalend\u00e1\u0159n\u00ed dny p\u0159ipadaj\u00edc\u00ed na kalend\u00e1\u0159n\u00ed m\u011bs\u00edce, v\u00a0nich\u017e OSV\u010c nebyla \u00fa\u010dastna poji\u0161t\u011bn\u00ed.<\/li>\n<\/ul>\n\n\n\n<p><strong>U zam\u011bstnanc\u016f sledujeme vylou\u010den\u00e9 dny formou nep\u0159\u00edtomnost\u00ed<\/strong>.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Vylou\u010den\u00fdmi dny JSOU<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>v\u0161echny dny DPN (bez ohledu na v\u00fdplatu n\u00e1hrady mzdy, nemocensk\u00e9 nebo je to ji\u017e nemoc po ukon\u010den\u00ed podp\u016fr\u010d\u00ed doby);<\/li>\n\n\n\n<li>DPN po \u010d\u00e1st dne (zam\u011bstnanec nap\u0159. 3 hodiny odpracoval a pot\u00e9 \u0161el k\u00a0l\u00e9ka\u0159i, kter\u00fd ho uznal do\u010dasn\u011b pr\u00e1ce neschopn\u00fdm);<\/li>\n\n\n\n<li>v\u0161echny dny karant\u00e9ny;<\/li>\n\n\n\n<li>v\u0161echny dny o\u0161et\u0159ovn\u00e9ho (bez ohledu na dobu vypl\u00e1cen\u00ed nemocensk\u00fdch d\u00e1vek);<\/li>\n\n\n\n<li>v\u0161echny dny dlouhodob\u00e9ho o\u0161et\u0159ovn\u00e9ho (bez ohledu na dobu vypl\u00e1cen\u00ed nemocensk\u00fdch d\u00e1vek);<\/li>\n\n\n\n<li>kalend\u00e1\u0159n\u00ed dny pen\u011b\u017eit\u00e9 pomoci v\u00a0mate\u0159stv\u00ed (mate\u0159sk\u00e1);<\/li>\n\n\n\n<li>kalend\u00e1\u0159n\u00ed dny rodi\u010dovsk\u00e9 dovolen\u00e9 do 4 let v\u011bku d\u00edt\u011bte;<\/li>\n\n\n\n<li>kalend\u00e1\u0159n\u00ed dny otcovsk\u00e9 poporodn\u00ed p\u00e9\u010de;<\/li>\n\n\n\n<li>neplacen\u00e9 volno.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Vylou\u010den\u00fdmi dny NEJSOU<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>dny, za kter\u00e9 n\u00e1le\u017e\u00ed n\u00e1hrada mzdy nebo platu nap\u0159.\n<ul class=\"wp-block-list\">\n<li>dovolen\u00e1,<\/li>\n\n\n\n<li>n\u00e1v\u0161t\u011bva l\u00e9ka\u0159e,<\/li>\n\n\n\n<li>darov\u00e1n\u00ed krve,<\/li>\n\n\n\n<li>svatba vlastn\u00ed nebo d\u011bt\u00ed,<\/li>\n\n\n\n<li>poh\u0159eb rodinn\u00e9ho p\u0159\u00edslu\u0161n\u00edka,<\/li>\n\n\n\n<li>zdravotn\u00ed volno (\u201esick\u00a0day);<\/li>\n<\/ul>\n<\/li>\n\n\n\n<li>dny DPN, kterou si zam\u011bstnanec zp\u016fsobil \u00famysln\u011b;<\/li>\n\n\n\n<li>dny \u010derp\u00e1n\u00ed n\u00e1hradn\u00edho volna za p\u0159es\u010das;<\/li>\n\n\n\n<li>dny \u010derp\u00e1n\u00ed n\u00e1hradn\u00edho volna za pr\u00e1ci ve sv\u00e1tek;<\/li>\n\n\n\n<li>dny, ve kter\u00fdch zam\u011bstnanec nepracoval z\u00a0d\u016fvodu p\u0159ek\u00e1\u017eek na stran\u011b zam\u011bstnavatele;<\/li>\n\n\n\n<li>dny neomluven\u00e9 absence.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\"><strong>P\u0159\u00edklady vylou\u010den\u00fdch dn\u00ed<\/strong><\/h2>\n\n\n\n<p><strong>P\u0159\u00edklad 1<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>O\u0161et\u0159ovn\u00e9 22 dn\u00ed, z\u00a0d\u00e1vek nemocensk\u00e9ho poji\u0161t\u011bn\u00ed hrazeno 9\u00a0dn\u00ed &#8211; vylou\u010den\u00fdmi\u00a0dny je cel\u00fdch 22 dn\u00ed<\/li>\n<\/ul>\n\n\n\n<p><strong>P\u0159\u00edklad 2<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Zam\u011bstnanec s osmihodinovou pracovn\u00ed dobou odpracoval 3 hodiny a pot\u00e9 \u0161el k\u00a0l\u00e9ka\u0159i, kter\u00fd ho uznal do\u010dasn\u011b pr\u00e1ce neschopn\u00fdm.\u00a0DPN trvala 7 kalend\u00e1\u0159n\u00edch dn\u00ed v\u010d. prvn\u00edho \u201epolovi\u010dn\u00edho\u201c dne \u2013 vylou\u010den\u00fdmi dny je 7 dn\u00ed.<\/li>\n<\/ul>\n\n\n\n<p><strong>P\u0159\u00edklad 3<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Zam\u011bstnanec odpracoval 3 hodiny a pot\u00e9 \u010derpal neplacen\u00e9 volno. Pracovn\u00ed doba zam\u011bstnance \u010din\u00ed 8 hodin. Vylou\u010den\u00fdm dnem je 0 dn\u00ed \u2013 omluven\u00e1 absence bez n\u00e1hrady mzdy (neplacen\u00e9 volno) bylo \u010derp\u00e1no ve dni, ve kter\u00e9m ale n\u00e1le\u017eela i mzda za odpracovanou dobu).<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\"><strong>Vylou\u010den\u00e9 DOBY<\/strong><\/h2>\n\n\n\n<p>Podl\u00e9haj\u00ed z\u00e1konu \u010d. 155\/1995 Sb., o d\u016fchodov\u00e9m poji\u0161t\u011bn\u00ed, \u00a7 16 odst. 4 a vykazuj\u00ed se v&nbsp;tiskopisu ELDP (Eviden\u010dn\u00ed list d\u016fchodov\u00e9ho poji\u0161t\u011bn\u00ed). Vylou\u010den\u00e9 doby se uv\u00e1d\u00ed v&nbsp;kalend\u00e1\u0159n\u00edch dnech.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Vylou\u010den\u00fdmi dobami jsou:<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\">\n<li>doba DPN, kterou si zam\u011bstnanec nezp\u016fsobil \u00famysln\u011b;<\/li>\n\n\n\n<li>doba karant\u00e9ny;<\/li>\n\n\n\n<li>doba, po kterou trvala pot\u0159eba o\u0161et\u0159ov\u00e1n\u00ed \u2013 nejv\u00fd\u0161e 9 kalend\u00e1\u0159n\u00edch dn\u00ed nebo 16 kalend\u00e1\u0159n\u00edch dn\u00ed, jedn\u00e1-li se o osam\u011bl\u00e9ho zam\u011bstnance;<\/li>\n\n\n\n<li>doba poskytov\u00e1n\u00ed dlouhodob\u00e9ho o\u0161et\u0159ovn\u00e9ho \u2013 nejd\u00e9le 90 kalend\u00e1\u0159n\u00edch dn\u00ed;<\/li>\n\n\n\n<li>doba otcovsk\u00e9 poporodn\u00ed p\u00e9\u010de \u2013 nejv\u00fd\u0161e 14 kalend\u00e1\u0159n\u00edch dn\u00ed;<\/li>\n\n\n\n<li>doba p\u0159ed porodem, po kterou nebyla vykon\u00e1v\u00e1na v\u00fdd\u011ble\u010dn\u00e1 \u010dinnost z\u00a0d\u016fvodu t\u011bhotenstv\u00ed, nejd\u0159\u00edve v\u0161ak od za\u010d\u00e1tku 8. t\u00fddne p\u0159ed o\u010dek\u00e1van\u00fdm dnem porodu do dne, kter\u00fd bezprost\u0159edn\u011b p\u0159edch\u00e1zel dni porodu.<\/li>\n<\/ul>\n\n\n\n<p><strong>Vylou\u010den\u00e9 doby se vykazuj\u00ed pouze v&nbsp;p\u0159\u00edpad\u011b, pokud se nekryj\u00ed s&nbsp;dobou<\/strong>:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>poji\u0161t\u011bn\u00ed, v\u00a0n\u00ed\u017e m\u011bl zam\u011bstnanec p\u0159\u00edjmy, kter\u00e9 se zahrnuj\u00ed do vym\u011b\u0159ovac\u00edho z\u00e1kladu pro stanoven\u00ed pojistn\u00e9ho na soci\u00e1ln\u00ed zabezpe\u010den\u00ed a st\u00e1tn\u00ed politiku zam\u011bstnanosti;<\/li>\n\n\n\n<li>za kterou n\u00e1le\u017eela n\u00e1hrada za ztr\u00e1tu na v\u00fdd\u011blku po skon\u010den\u00ed pracovn\u00ed neschopnosti n\u00e1le\u017eej\u00edc\u00ed za pracovn\u00ed \u00faraz (nemoc z\u00a0povol\u00e1n\u00ed) podle \u00a7 271b z\u00e1kon\u00edku pr\u00e1ce.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading has-text-align-center\"><strong>P\u0159\u00edklady vylou\u010den\u00fdch dob<\/strong><\/h2>\n\n\n\n<p><strong>P\u0159\u00edklad 1<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>O\u0161et\u0159ovn\u00e9 22 dn\u00ed, z\u00a0d\u00e1vek nemocensk\u00e9ho poji\u0161t\u011bn\u00ed hrazeno 9 dn\u00ed \u2013 vylou\u010denou dobou je 9 dn\u00ed.<\/li>\n<\/ul>\n\n\n\n<p><strong>P\u0159\u00edklad 2<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Zam\u011bstnanec s osmihodinovou sm\u011bnou odpracoval 3 hodiny a pot\u00e9 \u0161el k\u00a0l\u00e9ka\u0159i, kter\u00fd ho uznal do\u010dasn\u011b pr\u00e1ce neschopn\u00fdm.\u00a0 DPN trvala 7 kalend\u00e1\u0159n\u00edch dn\u00ed v\u010d. prvn\u00edho \u201epolovi\u010dn\u00edho\u201c dne \u2013 vylou\u010denou dobou je 6 dn\u00ed (prvn\u00ed den m\u011bl zam\u011bstnanec p\u0159\u00edjmy a do\u0161lo by ke kryt\u00ed vylou\u010den\u00fdch dob a p\u0159\u00edjm\u016f zahrnuj\u00edc\u00edch se do vym\u011b\u0159ovac\u00edho z\u00e1kladu).<\/li>\n<\/ul>\n\n\n\n<p><strong>P\u0159\u00edklad 3<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Zam\u011bstnanec odpracoval 3 hodiny a pot\u00e9 \u010derpal neplacen\u00e9 volno.
